Under Clause 146A of the Environmental Planning and Assessment Act 1979, and Division 7A of Part 9 of the Environmental Planning and Assessment Regulation 2000, at least one working Smoke Alarm must be installed on EACH level in all buildings in NSW where people sleep. The Smoke Alarms must meet the requirements of Australian Standard AS3786-2014. These provisions came into effect on 1 May 2006.
FOR HOMEOWNERS:
- Smoke Alarms must be installed on EVERY Level of your Home.
FOR TENANTS:
- Landlord must ensure at least one working Smoke Alarm on EVERY Level.
- Landlord installs Smoke Alarms in Rented Premises.
- Landlord can access Premises to fit Alarms with two days notice. R Tenant notifies Landlord if unable to change Battery.
FOR LANDLORDS:
- Neither Landlord nor Tenant can interfere with Smoke Alarm operation.
- Landlord installs new Battery at tenancy start.
- Landlord replaces Battery during tenancy.
- Tenant notifies Landlord if unable to change Battery.
- Condition Report must include Smoke Alarm details.
- Owners of Holiday Accommodation install and maintain Smoke Alarms.
- Additional laws for Boarding Houses and Backpackers.
FOR CARAVANS AND MOTORHOMES:
- Must have at least one working Smoke Alarm inside where bed is.
- Must have one in annex if people sleep there.
- Smoke Alarms must have a “Hush” Button.
FOR SHORT TERM RENTAL ACCOMODATION:
- Must be placed in EVERY Corridor or Hallway connected to Bedrooms,
or if NO Corridor or Hallway exists, in an area between Bedrooms and
the rest of the Building.
- Must also be installed on EVERY other Storey of the Dwelling that
does not have Bedrooms.
- Should be installed ON or near the Ceiling.
- Must comply with AS3786-2014.
- Must be powered either by Mains Electricity or a Non-removable Battery with a Minimum 10 Year Life Expectancy.
- Must be Interconnected.
ACCORDING TO FIRE SAFETY STANDARD HEAT ALARMS
- Required in any Private Garage attached to the Dwelling but not
physically connected to it. R Must be installed ON or near the Ceiling.
- Should be a class Type A1 or A2 Heat Alarm complying with AS1603.3. R Must be powered by Mains Electricity or a Non-removable Battery
with a Minimum 10 Year life expectancy.
- Must be Interconnected Alarms installed in the Dwelling.
